总 则

第一条
为了加强管理保险外汇资金的境外运用，防范风险，保障被保险人的利益，根据《中华人民共和国保险法》、《中华人民共和国外汇管理条例》等法律、行政法规，制定本办法。
Article
1 These Measures are formulated in
accordance with the Insurance Law of the People's Republic of China and
Regulations of the People's Republic of China on Foreign Exchange Control and
other laws and administrative regulations for the purposes of strengthening the
supervision of overseas use of foreign exchange insurance funds, preventing
risks and protecting the interests of the insured.
第二条
本办法所称保险公司是指在中华人民共和国境内，经中国保险监督管理委员会（以下简称中国保监会）批准设立并依法登记注册的中资保险公司、外资独资保险公司、中外合资保险公司和外国保险公司分公司。
Article
2 An insurance company in these
Measures refers to a Chinese insurance company, a wholly foreign-owned insurance
company, a Sino-foreign joint venture insurance company or a branch of foreign
insurance company established with the approval from the China Insurance
Regulatory Commission (hereinafter referred to as the “CIRC”) and registered
in accordance with the law.
